These Terms & Conditions ("Terms") are applicable to your utilization of our luxury yacht rental services and the website located at tranquilcommonshaven.sbs (hereinafter referred to as the "Service"), which is managed by TranquilCommonsHaven.

Engaging in a charter service or using our Service implies your acceptance of these Terms. Should you not agree with any part of the terms hereof, you may not use the Service.

2. Service Overview

At TranquilCommonsHaven, we offer first-class yacht charter services, which encompass but aren't restricted to:

• Daily rentals of yachts
• Evening sailing experiences
• Corporate outings
• Exclusive gatherings
• Journeys lasting multiple days

Our offerings are dependent on availability and prevailing weather conditions. We maintain the right to alter or cease services without prior notification.

3. Booking and Reservations

3.1 Booking Process

To arrange a charter, the following requirements must be met:

• Attainment of the minimum age of 18
• Provision of accurate and complete details
• Remittance of the necessary deposit as indicated in the booking confirmation
• Acceptance of these Terms & Conditions

3.2 Confirmation

Confirmation of your booking is only secured upon the completion of payment and through our written acknowledgment. We hold the discretion to decline service to any party.

3.3 Availability

All booked charters are contingent upon the selection and appropriateness of the vessel and suitable climatic conditions. Efforts will be made in good faith to fulfill your preferred scheduling.

4. Payment Terms

4.1 Pricing

All quoted costs are in € and incorporate applicable taxes, unless specified differently. Prices are subject to alteration without prior notice.

4.2 Payment Schedule

• Deposit: A payment equal to 50% of the entire cost of the charter, due at the time of reservation
• Final payment: Payable 48 hours prior to the departure of the charter
• Other charges (if any): Payable at the conclusion of the charter

4.3 Payment Methods

We offer acceptance of major credit cards, electronic fund transfers, and certified bank drafts. Our payment processing relies on secure, encrypted methods.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• Over 72 hours before departure: Refund in full, less transaction fees
• Between 24 to 72 hours before departure: Refund of 50%
• Under 24 hours before departure: No refund shall be provided

5.2 Weather Cancellations

In the case that our captain considers weather conditions unsuitable, we will propose either:

• A rebooking of your charter for an alternative available date, at no extra expense
• A complete refund if there is no possibility of rescheduling

5.3 Mechanical Issues

If the vessel assigned to you encounters mechanical failure, we will endeavor to offer an acceptable substitute. If a substitute cannot be provided, a refund in full will be granted.

6. Safety and Conduct

6.1 Safety Requirements

Expectations for all passengers include:

• Adherence to directives given by the crew
• Use of the provided safety gear as required
• Declaration of any pre-existing medical conditions that could impact their safety
• Staying within the designated areas onboard

6.2 Prohibited Items

The items not allowed onboard include, but are not limited to:

• Containers made of glass
• Illegal drugs
• Guns or any other weapons
• Excessive beverages (beyond a reasonable quota for consumption)
• Pets (except when previously agreed upon)

6.3 Conduct

All passengers are expected to behave in a manner that is respectful. We reserve the option to conclude the charter prematurely without reimbursement if the conduct of any passenger endangers safety or spoils the experience for others.

7. Liability and Insurance

7.1 Our Liability

Liability on our part is confined to the payment rendered for your charter. We are not responsible for:

• Injuries to one's person arising due to their own carelessness
• The loss of or damage to personal belongings
• Indirect, consequential, or supplementary punitive damages
• Delays brought about by weather or other conditions outside our influence

7.2 Insurance Coverage

We possess all-encompassing marine insurance that encompasses our vessels and related operations. It is the responsibility of passengers to ensure they have their own travel and personal insurance.

7.3 Assumption of Risk

By partaking in our charter offerings, you recognize the inherent perils associated with maritime activities and take upon yourself the accountability for your safety and health.

8. Modifications and Itinerary Changes

We reserve the privilege to adapt itineraries, paths, or timetables according to meteorological conditions, safety requirements, or other operational necessities. Every effort will be made to provide alternative experiences of comparable quality.

9. Force Majeure

We shall not be held responsible for interruptions, cancellations, or changes stemming from forces beyond our control, which include, but are not limited to:

• Extreme weather situations
• Catastrophic events of nature
• Rulings by the government
• Closures of ports
• Mechanical breakdowns

10. Privacy and Data Protection

We manage your personal data in compliance with our Privacy Policy. Utilizing our services signifies consent to the gathering and usage of your information as delineated in the Privacy Policy.

11. Intellectual Property
